Terms and conditions

These terms and conditions of use (hereinafter referred to as the “Terms and Conditions”) (hereinafter referred to as the “Service”) sets out the terms and conditions of use of the services provided by the Service (hereinafter referred to as the “Services”). The Terms of Use (“Terms and Conditions”) set out the terms and conditions of use of the services provided by the Service (“Services”).All users who register for or browse and use the Services (“Users”) may use the Services by agreeing to these Terms and Conditions.

1.Definition

The definitions of each term under these Terms and Conditions are as follows.

  1. “Services”: any and all services provided through the Services.
  2. “User”: the Member and all persons using the Service.
  3. “Products”: any and all goods, services, donations, support, etc. provided through the Services.
  4. “Prospective member”: a person who wishes to register as a member.
  5. “Member registration”: The state of being registered when a prospective member agrees to the Terms and Conditions, applies for membership services in accordance with the Terms and Conditions and the methods specified by the Service, and the Service approves the application.
  6. “Member”: a person who wishes to be provided with membership services, agrees to these Terms and Conditions and registers as a member, who has been approved by the Service.
  7. “Withdrawal”: the member cancels his/her registration details and terminates the provision of membership services in accordance with the Terms and Conditions and in the manner stipulated by the Service.

2.Adoption

These Terms and Conditions shall apply to all relations between the User and the Service in relation to the use of the Service.

3.Membership Registration

  1. A prospective member shall register as a member of the Service in the manner prescribed by the Service and shall be issued with an ID (hereinafter referred to as “ID”) by the Service. The person shall be the one who has been issued with an ID (“ID”) by the Service.When registering as a member, personal information such as the user’s address, name and e-mail address may be obtained.
  2. Whenever you are required to enter personal information for membership registration, make sure you enter the correct information.
  3. Personal data obtained by the Service shall be handled in accordance with the Privacy Policy separately set out by the Service.
  4. If the Service deems it inappropriate to approve you as a user, it may not approve your membership.
  5. The Service may disclose personal information obtained from users in the event of a request under the Provider Liability Act (official name: Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Demand Disclosure of Identification Information of the Senders).
  6. If the user is a minor, he or she must obtain the comprehensive consent of a parent or other legal representative in advance before using the Service.
  7. Only one membership registration is allowed per user.

4.Password management

  1. The user is entirely responsible for the management of the password registered for the Service and for its use.
  2. The password may not be transferred, sold or lent in any way.
  3. The Service shall not be liable for any damage resulting from negligent use of the password by the user or by third parties.Any declaration of intent made to the Service by means of a password shall be deemed to be a declaration of intent by the valid User corresponding to this password.

5.User information

  1. User information shall be owned by the Service, and personally identifiable information (name, address, telephone number and e-mail address) shall not, in principle, be provided outside the company, except to the extent necessary for the provision of the Service and to subcontractors, or with the consent of the user him/herself for disclosure. The information (name, address, telephone number and e-mail address) shall not, in principle, be provided outside the company, except to subcontractors within the scope necessary for the provision of the service and with the consent of the user him/herself.
  2. The User shall be responsible for the management of the authentication lent by the Service.
  3. The user shall not transfer, lend, sell or pledge the authorisation and shall not allow third parties to use it in any way.
  4. Regardless of the user’s intention or negligence, any damage caused by the leakage, publication or use by a third party of the authentication shall be borne by the user and the Service shall not bear any responsibility for such damage.
  5. The use of the Service made by the authorisation shall be deemed to have been made by the user to whom the Service has lent the authorisation and shall bear all obligations and responsibilities, irrespective of whether the use was made by the person himself/herself or not.
  6. Notwithstanding the preceding paragraph, user information may be disclosed without the consent of the user in the following cases.
    1. Disclosure to the police or relevant authorities if it is deemed detrimental to the Service, other users or third parties.
    2. If the police, court, prosecutor’s office, bar association, consumer affairs centre or any other body with equivalent authority requests the disclosure of registered information and the Service decides to comply with the request.
    3. Other cases where the Service considers the disclosure to be reasonable.
  7. The Service shall not accept any false declarations with regard to all items of information declared by the prospective member at the time of admission to membership.
  8. The Service shall not be liable for any damage incurred by the user as a result of unauthorised use of the account.
  9. If there is a change in the registration information or if the authentication information is known to a third party, or if there is a suspicion that the authentication is being used by a third party, the user shall immediately inform the Service of this in accordance with these Terms and Conditions and the method specified by the Service, and shall follow the instructions of the Service if any.
  10. The Service shall not be liable for any disadvantage, such as the User not being able to use the Service, as a result of the User’s failure to notify the Service in accordance with the preceding paragraph.

6.Prohibition of use outside the scope of private use

The User may not reproduce, sell, publish or otherwise use any information obtained through the Service beyond the scope of private use, unless authorised by the Service (including obtaining the consent of a third party through the Service if such third party has rights in the information in question). The third party shall not be entitled to use any information obtained through the Service beyond the scope of private use.

7.Prohibitions

  1. The Service prohibits any conduct by the User which is or may be.
    1. Acts against public order and morals.
    2. Criminal offences or acts connected with criminal offences.
    3. Acts in breach of, or connected with, laws and regulations, etc.
    4. Acts that infringe or may infringe the copyright or other intellectual property rights, portrait rights and publicity rights of the Service, other Users or third parties.
    5. Acts that infringe the property, privacy or other rights of the Service, other users or third parties.
    6. Acts that are detrimental to the Service, other users or third parties.
    7. Acts that defame or slander the Service, other Users or third parties.
    8. Acts that interfere with the operation of the Service or damage the Service’s reputation.
    9. All business activities using the identity of the user concerned that are not authorised by the Service.
    10. Election campaigning or similar activities, or activities in breach of the Public Offices Election Act or other laws and regulations.
    11. Making false responses to all questionnaires conducted by the Service, including the admission procedure.
    12. Disclosing harmful computer viruses, code, files or programmes, or suggesting where they have been disclosed.
    13. Acts that significantly overload the server or network.
    14. Alteration or deletion of information on the website relating to the Service.
    15. Unauthorised use of IDs and passwords.
    16. The collection of personal data of other users or third parties.
    17. Entrusting the operation of the account for the Service to a third party.
    18. Reselling or otherwise buying, selling or renting accounts for the Service, whether with or without compensation.
    19. Providing information that is or may be factually incorrect.
    20. Acts that may amount to child pornography or child abuse.
    21. Acts of posting information deemed harmful to minors, or acts that may lead to the aforementioned.
    22. Unauthorised acts of access (including access enhancement tools, etc.).
    23. Actions aimed solely at directing visitors to other websites.
    24. Actions aimed solely at effecting external links to other websites.
    25. Establishing or soliciting the establishment of an endless chain of pyramid scheme (Pyramid scheme).
    26. Misrepresenting oneself or one’s organisation, etc., whether an individual or a legal entity.
    27. Soliciting or seeking to proselytise to religious organisations or organisations that could be equated with them, or acts that could lead to such solicitation or proselytising.
    28. Acts that significantly overload the server or network.
    29. Providing information that is or may be factually incorrect.
    30. Acts of advertising the same or similar services to the services operations.
    31. Prohibited activity acts.
    32. Any other conduct deemed inappropriate by the Service.
  2. In the case of the preceding paragraph, if the Service suffers any damage, the User shall compensate the Service for such damage.

8.Termination of membership

  1. In the event of any of the following, the Service may terminate the membership without prior notice to or consent of the member concerned.
    1. In the event of a breach of these Terms and Conditions.
    2. If the membership information is false or erroneous.
    3. If the registered e-mail address is deemed to be non-functional.
    4. Unauthorised use of passwords or allowing them to be used.
    5. If a member registers by impersonating a third party.
    6. Violation of the prohibitions set out in “7” or any other provisions of these Terms and Conditions.
    7. If the information declared at the time of admission and in subsequent questionnaires is recognised by the Service as deliberate false declarations.
    8. If the Service is involved in fraudulent activities that it does not approve of.
    9. In the event of the death of a member.
    10. Any other cases deemed inappropriate by the Service.
  2. If the Service suffers any damage in the case of the preceding paragraph, the Member shall compensate the Service for such damage.
  3. If a member’s membership is terminated, all rights held by that member to the service shall be terminated.
  4. No compensation will be paid for damages resulting from the suspension or deletion of a user account.

9.Withdraw from a club

  1. If a member wishes to withdraw from the service, the member shall notify the service in accordance with the prescribed procedure, and the membership will be withdrawn after the withdrawal procedure has been completed by the service.However, due to the Service’s system, it may take a certain amount of time from the completion of the withdrawal procedure by the Member until the procedure is reflected in the system, and the Member accepts this.If a Member withdraws from the Service, he or she loses all rights as a Member, including the right to receive all services and the right to receive information by e-mail and other means.
  2. The Service shall not be obliged to retain any information about users, including personal data and data on posted content of users who have withdrawn from the Service.

10.Changes to the terms of reference

The Service reserves the right to change these Terms and Conditions without prior notice to or consent of the User.All users are deemed to have accepted the changes when they are displayed on the Service for one week.However, if unforeseen circumstances are foreseen, such as the possibility of causing detriment to third parties, the changes to the Terms and Conditions shall be deemed to have been implemented without waiting for the aforementioned period.

11.Interruption or suspension of services

  1. The Service may be suspended or discontinued in whole or in part without prior notice or consent of the User in the following cases.
    1. When the Service performs periodic or emergency maintenance and inspection of the computer systems for the provision of the Service.
    2. If the operation of the Service becomes impossible due to fire, power failure, natural disasters or other emergencies.
    3. If the operation of the Service becomes impossible due to war, civil war, riot, disturbance, labour disputes, etc.
    4. If the Service cannot be provided due to a faulty computer system for the provision of the Service, unauthorised access from a third party or infection by a computer virus.
    5. Where the Service cannot be provided due to legal or statutory action.
    6. Where the Service has informed the User in advance by e-mail or other means to a reasonable extent.
    7. In other cases where the Service deems it unavoidable.
  2. The Service shall not be liable for any disadvantage or damage caused to the User as a result of the above situation, etc.

12.Change or discontinuation of service content

  1. The Service may change the content or name of the Service at any time and at its discretion without prior notice to or consent from the User.
  2. Even if the service content is changed or discontinued in accordance with the preceding paragraph, the Service shall not be liable for any disadvantage or damage caused to the user.

13.Handling of personal data.

The personal information of the User obtained by the Service in connection with the use of the Service shall be handled in accordance with the Privacy Policy separately established by the Service.

14.Fees for use

15.Non payment and account suspension for paid services

If the user fails to pay for the paid services, the Service may suspend or delete the user’s account.

16.Disclaimer

  1. The Service shall not be liable for any damage suffered by the User or third parties as a result of delays or interruptions in the provision of the Service for any reason whatsoever.
  2. The Service shall not be liable for the accuracy or fitness for a particular purpose of any information or other information obtained through the use of the Service.
  3. The Service shall not be liable for any damage resulting from information, etc. obtained through the use of the Service.
  4. The Service shall not be liable for any communications, etc. to the User if the required information, etc. does not reach the User due to errors in the information registered by the User.
  5. If a dispute arises between the User and another User or a third party in relation to information or services provided through the Service, the User shall resolve the dispute at his/her own expense and responsibility and shall not cause any damage to the Service.
  6. The Service shall not be liable for the performance of obligations in connection with transactions such as the sale and purchase of goods and services between the User and third parties conducted through the Service, or for any other disputes arising in connection with such transactions.
  7. The Service shall not be liable to the User for any damage or liability in the event of claims, disputes or claims for damages due to the loss of data stored on the Service or the cessation of operation of the server.
  8. The Service shall not be liable for any problems arising from the disclosure of user information in accordance with Article 4.2.

19.Agreeable Jurisdiction

In the event of disputes regarding the Service, the court with jurisdiction over the location of the Service’s head office shall have exclusive jurisdiction.

20.Governing law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
